TÉRMINOS Y CONDICIONES DE COMPRA PRODUCTOS CROCHETTS

The Site allows orders to be placed with the company ADECOM SOLUCIONES S.L. for a selection of CROCHETS products (hereinafter, the “Product(s)”), directly online via the Internet, for delivery throughout the territory of the Iberian Peninsula, with the exception of Gibraltar, as well as to the Canary Islands, France, the United Kingdom, Germany, Italy, the Netherlands and Portugal.

Special orders may not be placed through the Website, consisting in particular of the creation of a product that does not exist or that is no longer part of the CROCHETS range, and in no case whatsoever will it be possible to adapt or customise a product belonging to the CROCHETS collections.

1- AVAILABILITY AND PRODUCTION STOCK.

The products offered and advertised through the site, as well as their prices, shall be fully valid for the consumer as long as they appear on the Site, although they shall in any case remain subject to availability due to the very nature of online purchasing, insofar as errors or modifications may exceptionally occur, particularly in the event of simultaneous orders for the same product by several customers.

If a product that has been purchased is not available, the consumer shall be informed within a maximum period of 72 hours from confirmation of the purchase, via the e-mail address provided to the Website or, where applicable, by telephone. Once this communication has been received, the consumer may choose an alternative product or, where applicable, cancel the purchase made.

ADECOM SOLUCIONES S.L. shall not be liable UNDER ANY CIRCUMSTANCES for the lack of stock or immediate availability of the products, and the consumer may, as indicated in the previous section, choose substitution or, where applicable, cancellation of the purchase made.

ADECOM SOLUCIONES S.L. reserves the right to modify, at any time and without prior notice, the products offered through the Website.

2- PURCHASE PROCESS FOR CROCHETTS PRODUCTS.

2.1) Selection of products:

The Website makes available to the consumer all products that may be the subject of a purchase, which may be added to the selection by clicking on the “ADD TO BASKET” option.

2.2) Completion of the purchase:

Once the selection is complete, using the “BUY” option you will have access to the summary of your purchase, which you can complete by clicking on the “COMPLETE PURCHASE” section.

If you already have an account, you must log in in order to use it. If you are not a customer, you must fill in the form made available to the USER with the data, both
billing and shipping, that are required and, where applicable, if you so wish for future purchases, you may create a new account.

2.2.a) – On the creation of a USER account.

The creation of an account enables the USER, among other things, to:

Track purchases, consult the history of orders placed, and modify data entered, whether of a personal nature or such as payment methods or delivery addresses, among others.

The preservation and confidentiality of the identification data, as well as the undertaking not to disclose them to third parties under any circumstances, shall be the SOLE and EXCLUSIVE responsibility of the user, and NEITHER ADECOM S.L. NOR ANY OF ITS GROUP COMPANIES SHALL UNDER ANY CIRCUMSTANCES BE LIABLE for the possible loss, theft, identity theft or any type of fraudulent use that third parties may make of the said data.

If you become aware that any of these circumstances or other similar ones have occurred, you must IMMEDIATELY notify the Website through the channel enabled for that purpose.

2.2.b) – Identifying data:

The data entered by the user on the website constitute sufficient proof of the purchase transactions and/or, where applicable, the returns and/or modifications of orders that may exist between ADECOM SOLUCIONES S.L. and the REGISTERED USER.

In the event of any divergence between the USER and ADECOM SOLUCIONES S.L. in relation to any action carried out, whether a purchase, modification or cancellation, whatever it may be, the data recorded by ADECOM SOLUCIONES S.L. and entered by the USER shall be considered irrefutable proof for all purposes.

2.2.c) – Cancellation of the account

The USER shall be entitled at all times to request the cancellation of the account by sending an e-mail to the address info@crochets.com

2.3 – Confirmation of the purchase.

Once the process described above has been completed and upon acceptance of these terms and conditions of sale, as well as the Website’s privacy policy, you will have to confirm the “Place order” option, at which point the sale shall be deemed perfected; however, prior to final confirmation, the USER must check the selection of products.

THE WEBSITE strives to ensure the faithful accuracy of the content displayed through it on computers or mobile devices, although it shall not be liable for the technical limitations in colour reproduction that may exist on any USER’s electronic devices; therefore, should the graphic representation raise any doubt in relation to reality, please contact the Customer Service department.
ADECOM SOLUCIONES S.L. reserves the right NOT to accept an order if it reasonably considers that the USER has infringed or may have infringed these Terms and Conditions, if there are indications of unlawful conduct on the part of the USER or for any other legitimate reason.

2.3.a) Identification of the purchase.

Once the purchase has been confirmed, you will receive, at the e-mail address provided to ADECOM SOLUCIONES S.L., a receipt of your purchase detailing the transaction.

2.4 – Prices and accepted payment methods.

2.4.a) Price of the items.

Prices shall be expressed in Euros or, where applicable and for purchases made in the United Kingdom, in Pounds sterling with their corresponding equivalent. Purchases shall carry the corresponding taxes and duties of each state, and the refund of the said amounts shall not, for tax purposes, proceed in any case, except:

I- In the event of cancellation of an order through the exercise of the right of withdrawal.

II- In the event of cancellation of the order due to defects or latent defects in the goods delivered.

In both cases, the consumer or user must be restored to the situation immediately prior to the purchase.

ADECOM SOLUCIONES S.L. reserves the right to modify, at any time and without prior notice, the price of the products offered. Payment shall be made immediately at the time of placing your order.

Applicable taxes

The prices of the products displayed on the Seller’s website include the Value Added Tax (VAT) that may, where applicable, be chargeable. Purchases to be delivered within the territory of any of the member states of the European Union shall be subject to VAT.

Payment method

When placing the order, the customer may freely choose to pay for their purchases by credit or debit card or payment method; or by other similar means. In certain cases and to prevent possible fraud, the Seller reserves the right to request a specific payment method from a customer when the identity of the buyer is not reliably verified. The website uses information security techniques generally accepted in the industry, such as firewalls, access control procedures and cryptographic mechanisms, all with the aim of preventing unauthorised access to data.

The customer may select the shipping method from among those available for their shipping zone. They should bear in mind that delivery times, the quality of service, the delivery point and the cost will be different for each transport method.

The Seller sends orders to its customers through different express transport companies of recognised national and international prestige. The delivery date at the customer’s address depends on the availability of the chosen product and the shipping zone. Indicative transport times are available in the “Shipping Costs” section of our website. Before confirming your order, the customer will be informed of the shipping costs and transport times, both indicative, that apply to their specific order depending on the volume of the purchase made. However, both may vary depending on the specific circumstances of each order. In particular:

Transport times may be altered by extraordinary incidents with the carrier and by difficulties in delivering the goods.
Buyer’s rights and returns policy

Once the order has been registered and the buyer has made the payment, the Customer may modify any item in their order for an amount equal to or greater than the one paid.

For customers using the ClearPay payment method, products will be dispatched within a maximum of 14 calendar days.

Under no circumstances may a paid order be cancelled.

RETURNS:

The USER must notify the Customer Service department of ADECOM SOLUCIONES S.L. as soon as possible of any delay or failure to deliver. ADECOM SOLUCIONES ONLINE S.L. will resolve the existing contingency as soon as possible. Any claim made more than 14 calendar days after the date on which the order should have been received will not be attended to.
3.2 – Withdrawal, Exchanges and Returns.
3.2.a) – USER’s Right of Withdrawal. The USER has the right of withdrawal within a period of 14 days from receipt of the order.
Returns covered by the withdrawal provided for in the TRLGDCU will not be accepted when the garments are found to have been used, handled, damaged or any other similar circumstance that prevents ADECOM SOLUCIONES S.L. from putting them up for sale in the same conditions as those in which they were sold to the USER exercising the withdrawal.
The USER shall be refunded all amounts, the price and the shipping costs, although the costs of returning the goods and making them available to ADECOM SOLUCIONES S.L. shall be borne by the USER, in accordance with the provisions of article 108.1 TRLGDCU, unless the order presents any contingency attributable to ADECOM SOLUCIONES S.L. upon receipt.

Returned items must be in perfect condition, unused, unwashed, with all labels and in their original packaging.

CROCHETS will offer the Buyer the possibility of exchanging the product or sending a voucher for the amount of said product, or refunding the purchase money by means of a bank transfer to the account indicated by the customer within a maximum period of 15 days.

Shipping costs will be free for purchases with a total value of 100€ or more; if the Customer makes a return whereby the amount of said purchase is reduced to less than 100 €, the established shipping cost of 3,99€ will be deducted from the refund.

The amount corresponding to the items to be returned shall be refunded; shipping and return costs shall never be refunded.

CROCHETS reserves the right not to accept a return if, once received, it does not comply with the conditions specified above, as well as if it is received out of time.

If a product other than the one requested by the customer is delivered due to an error by CROCHETS, it will be collected and the correct product will be delivered with no additional charge to the buyer.

Once the Customer has placed an order, it MAY NOT BE CANCELLED UNDER ANY CIRCUMSTANCES.
Customer obligations

The Seller’s customer undertakes at all times to provide truthful information on the data requested in the user registration or order placement forms, and to keep it updated at all times.

The customer undertakes to accept all the provisions and conditions set out in these General Terms and Conditions of Contract, understanding that they reflect the best possible service intent for the type of activity carried out by the Seller.

Likewise, the customer undertakes to keep their personal access credentials to our website confidential and with the utmost diligence.

The customer undertakes to make delivery of the requested order possible by providing a delivery address where the requested order can be delivered within the usual goods delivery hours (Monday to Friday from 10:00 to 13:30 and from 16:00 to 18:00). In the event of non-compliance by the customer with this obligation, the Seller shall have no liability whatsoever for the delay or impossibility of delivering the order requested by the customer.

Applicable law and competent jurisdiction

The sales made with the Seller are subject to the legislation of Spain. In the event of any conflict or discrepancy, the applicable jurisdiction shall be that of the Courts or Tribunals of the buyer.

2.5 – Ownership of the goods and retention until full payment.

The products purchased shall remain the property of ADECOM SOLUCIONES S.L. until full payment of their price and cost.

Once the order has been delivered to the indicated address, the USER shall assume all risks arising therefrom.

The privacy policy explains how we use and collect your personal information as well as the steps we have taken to protect it. This privacy policy explains your choices regarding the collection, use and disclosure of personal information. By visiting the website directly or through another site, you accept the practices described in this policy.
